    Intuit and HireVue publicly deny the allegations

    Both companies respond to press inquiries denying wrongdoing. An Intuit spokesperson says the allegations are "entirely without merit" and that Intuit "provide[s] reasonable accommodations to all candidates." HireVue CEO Jeremy Friedman calls the complaint "entirely without merit and... based on an inaccurate assumption about the technology used in the interview," adding that HireVue's AI "was not used in this instance" - a direct factual dispute with the complaint's own account of what happened during D.K.'s interview.

  2. Complaint Filed

    ACLU files a civil rights complaint on D.K.'s behalf

    The ACLU, ACLU of Colorado, Public Justice, and the law firm Eisenberg & Baum file a formal Complaint of Discrimination with the Colorado Civil Rights Division and the EEOC, on behalf of D.K., against both Intuit and HireVue. The complaint alleges violations of the Colorado Anti-Discrimination Act, the Americans with Disabilities Act, and Title VII of the Civil Rights Act - arguing HireVue's speech-recognition technology is unreliable for Deaf and non-white speakers, and that HireVue itself acted as an "employment agency" that aided and abetted Intuit's discrimination.

    Feedback email cites her "communication style"

    D.K. receives a follow-up email - which she believes was generated by HireVue's automated analysis of her interview - recommending she "practice active listening," give "more concise and direct answers," and demonstrate "flexibility in adapting your communication style to different audiences." The complaint argues these recommendations are directly tied to her being Deaf, not to any actual gap in her qualifications.

    Automated rejection

    D.K. receives an automated email stating Intuit had "decided to move forward with other candidates." According to the complaint, the candidates hired for the position were not deaf and/or Indigenous.

    Requested captioning accommodation isn't actually there

    D.K. requests CART (human-generated, real-time captioning) so she can access the interview's audio instructions and questions. Intuit tells her HireVue's software has built-in subtitles she can turn on - but when she starts the interview, no subtitle option exists. She has to rely on Google Chrome's automated captioning instead, which she found less accurate, particularly for complex terms.

  6. Promotion Process

    Intuit invites D.K. to a HireVue video interview for a promotion

    D.K., a Deaf, Pawnee employee who had worked at Intuit for five years with strong performance reviews and annual bonuses, applies for a Seasonal Manager promotion. Intuit emails her to move to the next step: a video interview conducted through HireVue's AI-scored assessment platform. D.K. had already personally raised concerns with Intuit's own Accessibility Team, at the end of the 2023 tax season, that HireVue's platform might exclude disabled applicants - Intuit used it anyway.
