Class settlement proceeds through a new Illinois state-court filing
Plaintiffs' counsel (McGuire Law) files a new class action in the Circuit Court of Lake County, Illinois (case 2026LA00000141) covering Illinois residents whose voice or facial biometric data was collected through HireVue's video-interview platform between January 27, 2017, and June 25, 2026 - the vehicle through which the settlement reached in the federal case is being brought to a state court for class-wide approval. Court largely denies HireVue's motion to dismiss
U.S. District Judge Jeremy C. Daniel rules on HireVue's motion to dismiss. He rejects HireVue's argument that Illinois courts lack personal jurisdiction over the Utah-based company, finding HireVue knowingly sold its software to an Illinois-headquartered company (Health Care Service Corporation) that used it to interview at least one plaintiff in Illinois. Case removed to federal court
Six Illinois residents - Kristen Deyerler, Max Ellithorpe, Bryen Zimmerman, Christopher Coats, Nicolas Galindo, and William Phemister - had filed a putative class action against HireVue, Inc. in the Circuit Court of Cook County, Illinois (case 2022-CH-00719) in early 2022, alleging HireVue's video-interview software captured their biometric information - specifically 'facial geometry' - without the notice, consent, and public retention policy required by the Illinois Biometric Information Privacy Act (BIPA). HireVue removes the case to the U.S. District Court for the Northern District of Illinois, where it is assigned case number 1:22-cv-01284.
